The rights and duties of a temporary employee

 

A temporary employee has the right to:

  • receive, no later than on the second day of performing temporary work, a written contract designating the parties to, and the type of, contract being concluded;
  • be treated, in respect of working conditions and other terms of employment, as favourably as those employees employed directly by the user employer in the same, or similar, posts;
  • be employed in a permanent position by the user employer, following the completion of the temporary work;
  • increase his/her tax-deductible expenses by 25 percent if the temporary employee lives outside the town where the employer’s establishment is located, and provided he/she receives no family separation allowance; To claim such an increase, you need to ask a Start People consultant for the relevant declaration and fill it in. If you don’t fill in such a declaration, the said increase can be claimed in your annual tax return, filed with your local Tax Office;
  • terminate the signed contract earlier, though only when the parties have allowed for such termination, and observing the stipulated period of notice;
  • avail him/herself of the user employer’s welfare facilities, in accordance with the principles applicable to the user employer’s own employees;
  • avail him/herself of the additional benefits related to working for Start People (see: Start People Employee Schemes);
  • receive remuneration for work in a timely manner.

A temporary employee is obliged:

  • to submit the appropriate documents and statements in connection with undertaking employment;
  • in a case where the employee has been registered as an unemployed person, to sign off from the register of unemployed persons kept by local Employment Office within five days of the day on which the temporary employment contract is signed;
  • to undergo the initial, and periodic, medical examinations;
  • to acquaint him/herself thoroughly with the signed temporary employment contract, paying special attention to any clauses regarding the possibility of earlier termination;
  • to comply with the established work schedule;
  • to comply with employment guidelines and occupational health and safety regulations (including fire protection regulations);
  • to observe the principles of community life applicable to the employer’s establishment;
  • to look after the interests of the employer’s establishment and protect its property;
  • to maintain the confidentiality of information, the disclosure of which could prove harmful to the employer;
  • to perform his/her work diligently and in a suitable manner;
  • to carry out the orders of managers, foremen and other employees authorised by the user employer to give orders;
  • to sign subsequent temporary employment contracts in a timely manner;
  • to collect employment certificates in a timely manner;
  • to notify the user employer and Start People of his/her justified absence in a timely manner;
  • to account for the property with which he/she is provided by Start People or the user employer (workwear and footwear, protective gear, locker keys, ID tag, etc.) within five days of concluding the temporary work;
  • to submit declarations of his/her wish to exercise his/her rights under Articles 148 and 178(2) of the Labour Code (performance of work for a maximum of eight hours a day / non-performance of any overtime, night and/or interrupted work / non-assignment of an employee outside his/her permanent place of work if the same is responsible for the care of a child aged four or less).

If both parents or guardians of a child aged four or less are employed by Start People, the said declaration is completed by only one of them.
